Queensland has a zero-tolerance policy for drug driving. Roadside saliva tests are designed to detect almost all common drugs, and you do not need to appear impaired to face charges. Even a trace amount in your system can result in prosecution.
Key Points
- Simply testing positive to a roadside drug test is enough to be charged.
- You do not have to be showing signs of impairment.
- Refusing or failing to provide a sample is itself an offence and carries severe penalties.
Penalties for Drug Driving
Driving with a Relevant Drug Present (Saliva Test)
- Licence disqualification: 1 to 9 months
- Large fines
- Possible imprisonment of up to 3 months
Driving Under the Influence of a Drug (Impairment Offence – No Swab Needed)
- Licence disqualification: at least 6 months
- Fines up to $4,673
- Possible imprisonment of up to 9 months
Repeat Drug Driving (within 5 years)
If you have a prior drug driving conviction in the last 5 years, the penalties are far harsher:
- Licence disqualification: up to 2 years
- Fines up to $10,014
- Imprisonment for a period determined by the court
Failing to Provide a Sample
- Fines up to $6,676
- Imprisonment of up to 6 months
- Treated as seriously as if you had been charged with driving under the influence of drugs
Long-Term Impact
Drug driving convictions do not just carry legal penalties — they can also affect:
- Your employment (particularly where driving is essential)
- Your ability to travel overseas
- Your criminal record and future opportunities
